Sigortacılıkta yeni bir yaklaşım: Katılım sigortacılığı

Abstract

İnsanoğlunun sosyo-ekonomik gelişimine paralel olarak, kendisini güvende hissetme eğilimi, zaman içinde ekonomik değerleri de kapsar hȃle gelerek tarihsel süreçte farklı isim ve uygulama biçimleriyle evrimleşen “sigorta” kavramını doğurmuştur. Batıya nazaran İslam toplumlarındaki görece daha geç gerçekleşen ilerleme ve refah düzeyindeki artış, sigortacılığa da İslami boyutta yeni bir bakış açısı kazandırmıştır. Geleneksel sigortacılığın çoğu ilkesinin İslami felsefeyle örtüşmemesi, sigortacılığı İslami kurallara göre yeniden şekillendirme ihtiyacını doğurmuştur. Bunun paralelinde klasik sigortanın risk transferi yerine, risk paylaşım odaklı farklı bir uygulama modeli geliştirilmiştir. Uluslararası terminolojisiyle takaful, bilhassa körfez ve bazı Güneydoğu Asya ülkelerinde köklü bir geçmişe sahip olmasına karşın; ülkemizde geçen yıl yayımlanan bir yönetmelik ile mevzuat alt yapısına kavuşturulmuştur. Bilhassa farklı hassasiyetleri olan kesimler bakımından, klasik sigorta ürünlerinin ikamesi niteliğindeki katılım sigortacılığı, uygulama teknikleri ve farklılıkları nedeniyle potansiyel sigortalılara net bir şekilde anlatılmalı ve kafalardaki soru işaretleri giderilmelidir. Bu kapsamda çalışmada özetle, tarihsel süreci ile katılım sigortacılığına ve ülkemizdeki mevcut duruma ışık tutulmaya gayret edilmiştir.

In parallel with the socio-economic development of human beings, the tendency to feel secure has also been covered the economic values over time and caused the concept of “insurance” evolving with different forms of names and applications in the historical process. The relatively late increase in developments and welfare in the Islamic societies in comparison to the West has given insurance business a point of Islamic view. Most principle of the conventional insurance does not comply with the Islamic philosophy, thus it is created the need to reshape insurance business according to the Islamic precepts. Accordingly, a different application model focused on risk sharing has been developed, instead of the risk transfer in classical insurance. Although takaful with international terminology has a long history especially in the Gulf States and some Southeast Asian countries; it has been brought to infrastructure with a regulation published last year in our country. Participation insurance as a substitute for classical insurance products, especially for sectors with different sensitivities, must be clearly explained to the potential policyholders due to application techniques and differences and the question marks in the mind must be eliminated. In conclusion, it is tried to provide an insight the participation insurance with its historical process and the current situation in our country in this study
