Hanefi hukukçularının metinlerinde zımmilerin hak ve sorumlulukları

Abstract

Tezde İslam toplumunun egemenliği altında yaşayan gayr-i müslimlerin hakları ve sorumluluklar Hanefi mezhebinin ilk dönem eserleri kapsamında incelenmektedir. Tezin hazırlanmasında tümevarım yöntemi metodu kullanılmıştır. İslam toplumunun egemenliği altında yaşayan gayr-i müslim unsurlar ticari faaliyetlerinin bazılarında Müslümanların sahip olmadıkları başka haklara da sahip oldukları görülmektedir. Zimmîler, özel hayatlarında Müslümanların sahip olmuş olduğu haklardan başka haklara sahiptirler. Zimmîler, harac, cizye ve gelir vergisi gibi ekonomik konuların yanı sıra sosyal hayata ilişkinde sorumlulukları bulunmaktadır.

The rights and responsibilities of non-Muslims who live under the rule of the Islamic society in the thesis are examined within the scope of the works of Hanefi mezhebin. The induction method was used to prepare the dissertation. In some of the commercial activities of non-Muslim elements living under the sovereignty of the Islamic society, it seems that some of them have other rights that Muslims do not have. Zimmis have other rights in their private lives than rights that Muslims have. They have responsibilities in relation to social life as well as economic issues such as zimmis, harac, cizye and income taxes.
