Ceninin malvarlığı hakları

Abstract

Cenin hak ehliyetini, sağ doğmak şartıyla, ana rahmine düştüğü andan itibaren kazanır. Hak ehliyeti bakımından ana rahmindeki embriyo ile tüpteki embriyo arasında fark yoktur. Cenine, sağ doğmak geciktirici şartına bağlı olarak, kişilik hakkı tanındığı gibi, bazı malvarlığı hakları da tanınmıştır. Cenin kanunî mirasçı olabilir; mirasçı atanabilir veya ona belirli mal vasiyet edilebilir. Cenin, üçüncü kişi lehine bir sözleşmede lehdar olabilir. Doğumundan önce haksız fiil sebebiyle zarar gördüyse, doğduktan sonra haksız fiili işleyenden maddî ve manevî tazminat talep edebilir. Cenin gelecekte kendisine destek olacak kişiyi kaybederse, destekten yoksun kalma tazminatı talep edebilir.
