5237 sayılı Türk Ceza Kanunu’nun (TCK) getirdiği en önemli
yenilik, fer’i ceza kavramına yer vermeyerek “hak yoksunlukları”
konusunu bir güvenlik tedbiri olarak düzenlemiş bulunmasıdır. TCK
53’üncü maddeye göre kasten işlenen bir suçtan dolayı hapis cezasına
mahkûmiyetin bir sonucu olarak kişi belli haklardan yoksun bırakılır. Söz
konusu hak yoksunluklarının biri de kişinin Türkiye Büyük Millet Meclisi
üyeliğinden yoksun bırakılmasıdır. Anayasanın 83 ve 84’üncü maddesi
hükümleri ile Meclis İçtüzüğünün 135 ve 136’ncı maddesi hükümleri
nazara alındığında TCK 53’üncü maddesi uyarınca hükmedilen TBMM
üyeliğinden yoksun bırakmaya ilişkin güvenlik tedbirinin infazı ikili bir
ayrımı gerektirmektedir. Anayasanın 76’ncı maddesinin 2’nci fıkrası ile
2839 sayılı Milletvekili Seçim Kanunun 11’inci maddesinde açıkça ismi
zikredilen suçlar ile bir yıldan fazla hapis cezasına mahkûmiyet halinde,
kişi infaz engeli olan dokunulmazlıktan yararlanamaz. Bu durumda
hükmedilen güvenlik tedbiri, milletvekili sıfatının sona ermesi
beklenmeksizin infaz edilir ve kişi TBMM üyeliğinden yoksun bırakılır.
Diğer hallerde ise hükmedilen cezanın ve güvenlik tedbirinin infazı
milletvekili sıfatının sona ermesine bırakılır.
The most important reform brought about by Turkish Penal Code
(TPC) Law No.5237 is that it does not include “accessory penalty“ so that
it regulated "rights deprivation” as a security measure. Based on TPC Law
article 53, a person who is sentenced to imprisonment because he or she
committed a crime intentionally deprives certain rights. One of these
deprivation of rights is that to leave the person deprived of membership of
the Grand National Assembly of Turkey (TBMM). Considering the
articles 83 and 84 of the Constitution of Turkey and articles 135 and 136
of TBMM bylaws, enforcement of security measure based on TPC Law
article 53 that deprives the person membership of TBMM requires a dual
separation. 2 nd paragraph of article 76 of the Constitution of Turkey and
article 11 of the PM Election Law No: 2839 indicate the type of crimes
that is not covered by parliamentary immunity, and it is also indicated that
those receiving imprisonment for more than a year is not protected by
legislative immunity. In this case, the individual’s post as the Member of
Parliament is terminated and the sentence is enforced immediately. In
other cases, the execution of the sentence and security measures is
postponed until the PM’s term is concluded.
