Çalışmamızın konusu “Gelişen Teknolojinin Doğurduğu Yeni Bir
Suç Türü: Kredi Kartı (POS) Tefeciliği”dir. TCK m. 241’de düzenlenen
ve bugün toplumda en çok işlenen suçlardan biri olan tefecilik, toplum ve
devlet için ciddi bir vakıadır. Tefecilik suçu gelişen teknoloji ile birlikte
yeni yöntemlerle işlenmektedir. POS tefeciliği, tefecilikte en çok tercih
edilen yöntemlerden biridir. POS tefeciliğinde menfaatlerin risksiz bir
şekilde hemen temin edilmesi, bunda önemli rol oynar. POS tefeciliği,
devletin vergi gelirlerini ciddi şekilde etkiler ve zarara uğramasına sebep
olur. Ayrıca diğer kişilerin de ekonomik sıkıntı içine düşmelerine neden
olur. Gerekli denetimlerle bu suçun işlenmesinin önüne geçilmesi kamu
menfaati bakımından önem arz eder.
This study relates to “The POS (Point of Sale) Usury: A New Type
of Crime Engendered by Devoloping Technology”. The usury which is
regulated under the article 241 of Turkish Penal Code as one of the
crimes, is considered as a serious fact for both the society and the state.
Morover as a result of devoloping technology, this crime is commited with new methods such as POS. Since providing immediate risk free
interest plays a major role in the POS usury, this method became one of
the most favored method of usury. In fact, POS usury seriously affects the
tax revenues and as a consequent damages both the country’s economy
and the people who barrowed modey. Therefore preventing this crime
with the necessery measures has a significant importance for the public
interest.
