Türk Medeni Kanununda mirasçıların alacaklılarını korumak
amacıyla iki önemli dava olanağı getirilmiştir. Bunlardan ilki, tenkis
davası açmaktan imtina etmiş saklı paylı mirasçının alacaklıları ve iflas
idaresine tanınan tenkis davası açma hakkıdır. İkincisi ise mirası reddeden
mirasçının alacaklılarına ve iflas idaresine tanınmış olan reddin iptali
davasıdır. Her iki halde de mirasçının kendi iradesi ile malvarlığına
eklenmesi muhtemel bir değerden mahrum kalması ve bu durumda
alacaklıları koruma düşüncesi söz konusudur. Miras hakkından ivazsız
feragat eden mirasçı da müstakbel ve muhtemel miras hakkından kendi
iradesi ile vazgeçmektedir. Ancak kanunumuzda bu durumda alacaklıları
koruyan bir dava olanağı öngörülmemiştir. İcra İflas Kanununda
düzenlenen tasarrufun iptali davası, genel olarak alacaklıyı borçlunun
hileli davranışlarına karşı koruma amacı taşımaktadır. Çalışmanın amacı
öncelikle Medeni Kanunda mirasçıların alacaklılarına tanınmış dava
olanakları ile tasarrufun iptali davasının karşılaştırılmasıdır. Ardından
ivazsız feragat halinde mirasçının alacaklılarının tasarrufun iptali davası
açabilmesi olanağı tartışılacaktır.
In order to provide protection for creditors of heirs, two important
actions are regulated by the Turkish Civil Code. The first is to provide an
opportunity for the creditors of the heir or the bankruptcy administration
to bring the action of reduction in such cases that the heir, who has a
reserved portion of inheritance, has abstained from bringing the action of
reduction on his/her behalf. The second is to grant an action for the
annulment of renunciation of inheritance to the creditors of the heir who
has refused the inheritance and the bankruptcy administration in event of
his/her bankruptcy. In both cases the heir has voluntarily deprived
himself/herself of a value which is supposed to add to his/her own assets.
Also the heir who renounces gratuitously of his/her inheritance voluntarily
waives the right to his/her expectant and potential inheritance. However,
there is no action in the Civil Code dedicated to the protection of creditors
of the heir who renounces gratuitously of his/her inheritance. The
objective of the actio Paulina, which is regulated in the Code of
Execution and Bankruptcy, generally is to protect creditors from the
fraudulent conduct of debtors. The aim of this article is firstly to compare
the actio Paulina with the actions dedicated to the protection of creditors
of heirs in the Civil Code. Thereafter it will explore the possibility of
bringing the actio Paulina by creditors of the heir who has renounced the
inheritance gratuitously.
