Günümüzde toplumsal olaylara ve terör eylemlerine sıkça
rastlanılmaktadır. Bu olay ve eylemler neticesinde oluşan zararın kim
tarafından karşılanacağı konusu önem arz etmektedir. 2004 yılında
çıkarılan 5233 sayılı kanun ile terör eylemleri neticesinde oluşan zararı
idare karşılayacaktır. Ancak toplumsal olaylar açısından konu
tartışmalıdır. Fransa Hukuku’ndan Türk Hukukuna geçen sosyal risk
ilkesine göre toplumsal olaylardan doğan zararı idare karşılamalıdır.
Sosyal risk ilkesi içtihadi bir ilkedir ve bu ilkeye göre idare ile toplumsal
olay sonucu oluşan zarar arasında illiyet bağı olmasa dahi idare oluşan
zararı karşılamalıdır. İlliyet bağının olmaması sosyal risk ilkesinin
hukukiliği sorununu da gündeme getirmektedir.
Acts of terrorism and social events have frequently occurred at the
present time. It is highly important whether who to compensate damage
caused by these acts. On the basis of the Law 5233 introduced in 2004, the
Administration must compensate damage caused by terrorist acts. Yet, it
is controversial in terms of social events. According to the principle of social risk passed to Turkish Law from French Law, damage caused by
such social events must be compensated by the Administration. This
principle is a case law principle which obligates the Administration to
compensate damage regardless the existence of causal link between the
damage and the social event. The absences of causal link bring the legality
of the principle of social risk into question.
