Geçmiş yüzyıllar boyunca insanoğlu, sağlığını korumak veya sağlığına kavuşmak
amacıyla ilaç kullanmıştır. Özellikle 20. yüzyılda, ilaç endüstrisinde meydana gelen hızlı
gelişim, beraberinde ilaç üreticisinin sorumluluğu problemlerini getirmiştir. Almanya’da
meydana gelen Contergan faciası ile birlikte hukuk bilimi bu sorunun üzerine eğilmiş ve
hatalı üretilen ilaçtan doğan sorumluluğa ilişkin çeşitli çözüm önerileri getirmiştir.
Almanya’da ayrı bir ilaç kanunu yapılmış (Alman İlaç Kanunu= AMG) ve hatalı üretilen
ilaçtan doğan sorumluluğa dair düzenlemeler (§ 84-§ 94a) bu kanunun içinde yer alırken,
Türk hukukunda konu ürün sorumluluğu ve üreticinin sorumluluğu çerçevesinde ele
alınmıştır. Ancak bir takım özel hâllerde, sorumluluğun belirlenmesi ve sorumluluğun
yöneltileceği kişi hususunda sorunlar ortaya çıkmış, bunun neticesinde gerek Alman
hukukunda gerekse Türk hukukunda söz konusu olaylarda uygulanacak hükümlerin tespiti
tartışılmalı birer nokta olarak kalmıştır. Bu özel durumlara ilişkin tartışmalar bilhassa,
etkisiz ilaçlar (wirkungslose Arzneimittel), beklenmeyen yan etki (unerwartete
Nebenwirkung), karşılıklı etkileşim (Wechselwirkung) ve endikasyon dışı ilaç kullanımı
(Off- Label – Use) hususunda yoğunlaşmıştır. Yukarıda bahsedilen her bir olay açısından
ilacı kullanan bakımından bir zarar meydana geldiği muhakkaktır. Nitekim etkisiz ilaç
kullanımında, hastanın tedavi süreci uzamakta, beklenmeyen yan etki ve karşılıklı
etkileşimde ise gelişim hatası söz konusu olmakta ve tıp bilimi ile tıp tekniğinin ulaştığı
noktada beklenmeyen yan etkinin ve karşılıklı etkileşimin tespitinin mümkün olması
hâlinde sorumluluk doğacaktır. Endikasyon dışı ilaç kullanımında ise, ruhsatlandırılmış
olan ilacın, kullanım alanı dışında tatbiki mevcut olduğundan, tedavi özgürlüğü
çerçevesinde ilacın kullanılmasını tavsiye eden veya talep eden hekimin sorumluluğundan
bahsedilecektir.
Throughout the centuries, for protection their health or for recovery, mankind has
used drugs. Especially in the 20th century, the rapid development in pharmaceutical industry has brought the drug product liability issues. As a result of Contergan disaster in
Germany, legal solutions related to defective products have been suggested. In Germany,
Medicinal Products Act (‘‘ The Drug Law’’) that regulates the liability related to defective
products (§ 84-§ 94a) was enacted whereas according to Turkish Law the same subject is
dealt with liability for defective products and liability of manufacturers. However, under
special circumstances due to difficulty in detecting liability and the tort feasor, both in
Germany and Turkey the application of the provisions constitutes a controversial issue.
The dispute is mostly related to ineffective pharmaceutical products, unexpected side
effects, drug interaction and off-label use of drugs. It is obvious that each of the
abovementioned problems cause damages. As a matter of fact the usage of ineffective
pharmaceutical products increases the length of recovery period, unexpected side effects
and drug interaction causes development defect, which triggers the liability mechanism
when it is possible to detect with the assistance of the developments in technology and
medical science. Because of the fact that licensed drugs can be used other than its main
usage, by depending on freedom of drug usage people or doctors who give advice for the
drugs can be held legally responsible in case of off-label use of drugs
