Gebeliğin sonlandırılmasında aydınlatılmış rıza

Abstract

Gebeliğin sonlandırılması diğer hukuk sistemlerinde olduğu gibi Türk Hukuku'nda da tartışmalara neden olmuştur. Bu tartışmalar daha çok kadının kendi bedeni üzerinde karar verme hakkı ile henüz kişiliğini kazanmamış ceninin geleceğe dönük yaşama umudunun çatışması hâlinde hangi çıkarın üstün tutulacağına ilişkindir. Türk Hukuku'nda gebeliğin sonlandırılması, Nüfus Planlaması Hakkında Kanun'da, bu kanuna dayanılarak çıkarılmış Rahim Tahliyesi ve Sterilizasyon Hizmetlerinin Yürütülmesi ve Denetlenmesine İlişkin Tüzük'te ve Türk Ceza Kanunu'nda düzenlenmiştir. Bu hükümlerle gebeliğin isteyerek sonlandırılması, sorunlu gebelikler açısından gebeliğin sonlandırılması, cinsel saldırı hâlinde gebeliğin sonlandırılması ve gebeliğin sonlandırılması için aranan iznin alınacağı kişiler ve iznin alınma usulü düzenlenmiştir. Bu çalışmada, düzenlenen bu hükümlerin kapsamı, kadının kendi bedeni üzerinde karar verme hakkına nasıl sınırlamalar getirildiği ve bu hükümlerin uygulanabilirliği hususu ortaya konulmaya çalışılmıştır. Türk Ceza Kanunu'nda düzenlenen çocuk düşürme ve düşürtme suçlarına ise, cinsel saldırı hâlinde gebeliğin sonlandırılması hükümleri dışında değinilmemiştir.

Termination of pregnancy has led to debate in Turkish Law as in other law systems. Miscarrying and to make miscarry to someone held in the Turkish Penal Code the offense, termination of pregnancy is not addressed except for the provisions in the sexual assault case.
