Öz:Türk hukukunun da üyesi olduğu Kıta Avrupası hukuk sisteminin temelini Roma hukuku oluşturmaktadır. Bu bakımdan bilhassa borçlar hukuku kurumlar ının incelenmesinde Roma hukuku kaynaklarının dikkate alınması gerekir. Şart kurumu bakı mından da aynı esas geçerlidir. Nitekim Türk ve Roma hukukunda şarta ilişkin hükümler arası nda büyük bir benzerlik vardır. Şart kurumu, tarafların yaptıkları hukukî işlemi çeşitli ihtimaller çerçevesinde şekillendirmesine imkân tanır. Bir olgunun şart olarak kabul edilebilmesi için belirli unsurları taşıması gerekir. Şartın gelece ğe ilişkin olması ve gerçekleşip gerçekleşmeyeceğinin objektif olarak şüpheli olması elzemdir. Her ne kadar öğretide iradî – tesadüfî – karma şart, olumlu – olumsuz ş art ve gerçekleşebilecek – gerçekleşemeyecek şart gibi farklı tasnifler yapılsa da esas olan geciktirici – bozucu şart ayrımıdır. Zira doğurdukları hüküm ve sonuçlar bakımından anılan iki şart türü arasında ciddi farklar mevcuttur. Geciktirici ş arta bağlı hukukî işlem, şartın gerçekleşmesi anına kadar askıda hükümsüzdür; ancak şartın gerçekleşmesiyle hüküm ve sonuçlarını doğurur. Bozucu şarta ba ğlı hukukî işlem ise kurulduğu andan itibaren hüküm ve sonuçlarını doğurur; ancak şart gerçekleşirse hukukî işlem kesin hükümsüz hâle gelir.
Öz:Roman law forms the basis of Continental European legal system of which Turkish law is also a member. In this respect, Roman law sources must be considered while examining the institutions of law of obligations. The same principle is also applied for institution of condition. In fact, there is a great similarity between the provisions on condition in Turkish and Roman law. The institution of condition allows the parties to shape their legal transactions within the framework of various possibilities. A provision must bear certain elements in order to be accepted as a condition. First of all, the condition must indicate a future event and such event must be objectively suspicious whether or not will realise. Although different classifications are made such as potestative – causal – mixed condition, positive – negative condition and realisable – unrealisable condition, in Turkish legal system the distinction as suspensive – resolutive condition is the basic one, since there are significant differences between suspensive and resolutive conditions in terms of their effects and consequences. Suspensive conditional legal transaction is provisional ineffective until the condition occurs, but becomes effective and bear legal consequences when the condition occurs. On the other hand, resolutive conditional legal transaction is effective upon the conclusion of the transaction and bears legal consequences; however, if the condition is fulfilled, the legal transaction becomes null and void.
