Endüstriyel tasarımların fikir ve sanat eserleri kanunu kapsamında korunması

Abstract

The provisions of the Law of Copyrights and Neighbouring Rights can also be used for the protection of industrial designs, in the Turkish legislation. But, for the abovementioned protection the design should have the characteristics of a work of art under the Law of Copyrights and Neighbouring Rights. The design which has the characteristics of a work of art grants its owner the rights under the Law of Copyrights and Neighbouring Rights and it is protected according to the provisions of this law. The protection under the Law of Copyrights and Neighbouring Rights has its advantages and disadvantages compared to the other methods of protection. In this article, the protection of designs under the Law of Copyrights and Neighbouring Rights and the comparison of this method of protection with the other methods of protection will be dealt with.

Türk Hukukunda, endüstriyel tasarımların korunmasında Fikir ve Sanat Eserleri Kanunu hükümlerinden de yararlanılabilir. Ancak, söz konusu koruma için tasarımın, FSEK kapsamında eser niteliği taşıması gerekir. Eser niteliği taşıyan tasarım sahibine, FSEK kapsamında hak sağlar ve bu kanun kapsamında korunur. FSEK kapsamında korumanın diğer koruma usullerine göre avantajları ve dezavantajları bulunmaktadır. Çalışmada hem tasarımların FSEK kapsamında korunması, hem de bu koruma metodunun diğer usullerle karşılaştırılması üzerinde durulacaktır.
