Abstract:
Öz:Konut ve çatılı işyeri kira sözleşmelerinin bildirim yoluyla sona ermesi 6098 sayılı Türk Borçlar Kanunu'nun 347. maddesinde düzenlenmiştir. Bu maddenin birinci fıkrası, belirli süreli konut ve çatılı işyeri kira sözleşmelerinin sona ermesine ilişkindir. Bu hükme göre, belirli süreli konut ve çatılı işyeri kira sözleşmelerinde, sözleşme süresinin bitiminden en az on beş gün önce bildirimde bulunarak kiracı, sözleşmeyi sona erdirebilir; kiraya veren ise sözleşme süresinin bitimine dayanarak sözleşmeyi sona erdiremez. Başka bir deyişle belirli süreli konut ve çatılı işyeri kira sözleşmelerini bildirim yoluyla sona erdirme hakkı, kural olarak yalnızca kiracıya aittir. TBK md. 347 f.1 c.3'e göre, "Ancak, on yıllık uzama süresi sonunda kiraya veren, bu süreyi izleyen her uzama yılının bitiminden en az üç ay önce bildirimde bulunmak koşuluyla, herhangi bir sebep göstermeksizin sözleşmeye son verebilir". Bu düzenleme 6570 sayılı Gayrimenkul Kiraları Hakkında Kanun'da karşılığı bulunmayan yeni bir düzenlemedir. TBK md. 347 f.1 c.3'te geçen on yıllık uzama süresi ifadesinden ne anlaşılması gerektiği doktrinde tartışmalı olduğu gibi, Yargıtay'ın farklı daireleri arasında da görüş birliği bulunmamaktadır.
Başlık (İngilizce):THE EXTENSION OF TIME FOR TEN YEARS IN THE TERMINATION OF LEASE CONTRACTS OF RESIDENTIAL AND COMMERCIAL PREMISES BY THE LESSOR BY GIVING NOTICE (Turkish Code of Obligations Art.347 parag.1)
Öz (İngilizce):The termination of lease contracts of residential and commercial premises has been regulated in the 347th article of Turkish Code of Obligations numbered 6098. First paragraph of the article is about the termination of lease contracts of residential and commercial premises concluded for a limited duration. According to the paragraph, by giving fifteen days' notice before the end of the limited duration, the lessee may terminate a lease contract of residential and commercial premise. However, depending upon the expiry of the limited duration, the lessor may not terminate the contract. In other words, in principle only the lessee has right to terminate the lease contract of residential and commercial premise by giving notice. According to the 3rd sentence of article 347, paragraph 1 of Turkish Code of Obligations, "Solely, the lessor may terminate the contract at the extension of time for ten years by giving at least three months' notice before the end of each year which follows this time, without any reason". This is a new regulation that did not exist in the Law on the Rental of Immovable numbered 6570. What should be understood from the phrase "extension of time for ten years" is a controversial subject in the doctrine. Besides, there is not an agreement between the chambers of the Cassation Court about the subject.
