Negatif yükümlülük, devletlerin, Sözleşme‟de yer alan istisna halleri dışında kasıtlı olarak hiç kimseyi öldürmemelerini; pozitif yükümlülük ise, devletlerin kendi yetki alanındaki herkesin yaşam hakkını korumasını ifade eder. Sözleşme‟de yer alan haklar teorik değil, gerçek ve fiilen var olan haklardır. Bu sebeple devlet, önce öldürmeme yükümünü kendisi yerine getirecek, sonra da kişinin hayatını, ölümle sonuçlanabilecek eylemlere karşı korumak için uygun önlemleri alacaktır. Bu çalışmada öncelikle yaşam hakkı kavramı ve pozitif yükümlülük kavramları genel olarak açıklanacak daha sonra yaşam hakkı kapsamında Avrupa insan Hakları Mahkemesi kararlarında yer alan pozitif yükümlülükler kategorize edilecektirThe right to life arranged in the second article of the European convention of human rights imposes to the state parties two types of obligation which are negative and positive. Negative obligation means that states should not kill intentionally except for the exceptions stated in the convention as a restricted manner. The concept of positive obligations refers to the states' duty, within the scope of their authority, i.e. the protection of the right to life of every person. The rights taken part in the Convention are not theoretical, on the contrary, they are real and de facto rights. That‟s why, state, first and foremost, should fulfil not to kill, then should take an appropriate measures to protect a person's life against actions that can result in death.
