İslâm tarihinde müçtehit imamlar tarafından hadislerin değerlendirilip yorumlanması hususunda farklı farklı metodlar ortaya konmuştur. Bu farklılıklar, Hz. Peygamber (s.a.v) döneminden itibaren varlığını hissettiren ehl-i hadis ve ehl-i rey yaklaşımlarıdır. Bu farklı metodlar neticesinde her iki ekol zaman zaman birbirlerini sünnete muhalif olmakla itham etmişlerdir. Muhammed Şeybânî'nin hemen her meseleyi hadis ve âsâr çevçevesinde istidlalde bulunması kendisinin muhaddis fakih kimliğini de ayrıca ortaya koymuştur. Bazı konularda Şeybânî'nin, Kûfeli hocalarından farklı olarak rivâyetlere bağlı kalması, onun ehl-i hadisle olan sıkı temasının bir ektisi olarak görülür. Bu sebeplerden dolayı Şeybânî'yi; ''geçiş dönemi âlimi'', bazıları da; ''ehl-i hadis ile ehl-i rey ekollerini mezc eden âlim'' olarak kabul etmişlerdir. Çalışmamızda bu dönemlerin ehl-i hadis ve ehl-i rey çerçevesinde ihtilaf nedenlerine kısmen değinilmiş, sonra da iki ekol arasında yaklaşım ve etkileşimin öncüsü sayılan Muhammed Şeybânî'nin Muvatta nüshasından hareketle onun hadis ve sünnet konusundaki görüş ve değerlendirmeleri, hocası Mâlik hakkındaki bazı tenkitleri çerçevesinde ortaya konmaya çalışılmıştır. Nitekim her iki imâmın da farklı iki bölgede yetişmiş olmalarına ve birinin ehl-i hadise diğerinin de ehl-i reye mensubiyetine rağmen sünnetin tespitine, istidlal ve tenkit yöntemlerine bakıldığında aralarında büyük benzerliklerin olduğu görülür. Kısaca Şeybânî'ye göre sünnet; İslam beldelerindeki önceki fâkihler arasında yaygın olan ve amel edilen şeylerdir. Mâlik'e göre sünnet ise; Medîne'deki yaygın amel ve orada yaşayan âlimlerin ittifaklarıdır. İmam Malik'in "amel-i ehl-i Medîne", "Bizde üzerinde ittifak edilmiş amel", "İnsanların uygulaması", "Bilinegelen uygulama" vb. ifadelerle tanımladığı uygulama da ona göre önemli ölçüde bu anlamda sünneti içermektedir. Ancak bu nitelikteki uygulamalarla toplumdaki örf ve adetlerin karıştırılması tehlikesi her zaman mevcut olduğundan genel sünnet tanımının daha açık bir hale getirilmesine ihtiyaç duyulmuştur. Şeybânî sünnet malzemesinin tespitinde, gittikçe artan oranda dini nitelikli sünnet ve yerel örf ve adetlerle karışmış sünnetleri birbirinden ayırma çabasına girdiğini gösteren bu çalışmamız; Muvatta gibi meşhur bir eser bağlamında, Şeybânî'nin ortaya koydukları usûl ve istidlal yönetemlerini bir nebze de olsa ortaya koymak ve Muvatta'ın en meşhur nüshası olan Yahâ b. In Islamic history, different methods of evaluating and interpreting hadiths by the well-known (influentials) ulamas (scholars) have been put forward. These differences, It is theapproach of the Ahl-i hadith and the Ahl-i ray who felt their existence during the era of the Prophet (pbuh). As a result of these different methods, both sides (schools) accused each other of opposing the sunnah (teachings or traditions of the phophets). The fact that Muhammad Shaybānī had to put forth virtually every matter in the hadith and the realm of Islam had also revealed his own identity. In some cases, Shaybānī is dependent on hadith in a different way than the scholars of Irak. it has been regarded as a fundamental event. Because of these reasons, Shaybānī has accepted the civilizations as "the transition period" and "others" as "scholars of the schools of the Ahl-t-hadith and the Ahl-i ray" In our study, the views and evaluations of his hadith and sunnah on the subject of Muhammad Shaybani's Muwat al-Shaybānī, considered as the forerunner of the approach and interaction between the two schools, were discussed in detail in the ahl-i hadith and the ahl-i ray frame work, futher more Mohammed Shaybani also try to criticizes some of the views of his teacher İmam Malik. As a matter of fact, it is seen that both Imam's (ulamas) have been raised in two different regions, and that the reare similarities between them. In summary, according to Shaybānī, sunnah is something that is common and prevalent among the previous ulama in Islamic lands. According to the sunnah of Malik; It is the alliance of wide spread conduct in Medina and the scholars living there. Imam Malik's "amal- ahl Madina", "the practice which is allied in our view", "the application of people", the known application" etc. İn addition this kind of objectives might have been dangerous to the society, whice give room to used more safe objectives. Muhammad Shaybānī has been trying to separate the sunnah, which is religiously qualified and sunnah with the local customs and traditions, in the ascending order in the determination of the material of the Sunnah, and this is our work. In the context of a well-known work such as Muvatta, it is necessary to reveal the modalities and the tendencies of Shaybānī, which arerevealed in someway, and to find out the most famous scriptures of Muvatta, Yahyá b.
