1982 Anayasasının 70 inci maddesine göre, “Her Türk, kamu
hizmetlerine girme hakkına sahiptir. Hizmete alınmada, görevin
gerektirdiği niteliklerden başka hiçbir ayırım gözetilemez.” Bu, personel
istihdamında liyakate dayalı bir sisteme işaret eder. Yağma sisteminin
karşıtı olan liyakat sisteminde, kişinin siyasi referanslarına göre değil,
görevin gerektirdiği niteliklere sahip olmasına göre istihdamı ve görevde
yükselmesi söz konusudur. Hukuki bir bakış açısına göre, bütün kamu
personel sistemlerinin liyakate dayanması ve kamu hizmeti görevlilerinin
siyasal etkilerden uzak olması gerekir. Liyakat sistemine dayalı bir
istihdamda, bütün atamalar ve görevde yükselmelerde, geçerli ve güvenilir
bir yarışma sınavına ya da objektif diğer kriterlere göre belirlenebilecek
ilgili hizmete en uygun niteliğin esas alınması söz konusudur. Böyle bir
atama ve görevde yükseltilme, ırk, din, cinsiyet, medeni durum ve benzeri
diğer ayrımcılığı reddeder ve adil ve eşit bir uygulama sunar. Görüldüğü
üzere, liyakat kavramı, idarenin ihtiyaçları ve beklentileri ile adayın bilgi, beceri, deneyim ve kabiliyetlerinin mümkün olduğunca yüksek oranda
örtüşmesine işaret eder. Önemli olmakla birlikte liyakat ilkesinin anlamı
ve kapsamı konusu halen tartışmalıdır. Bu çalışmada öncelikle kamu
hizmetine girme hakkı incelenecek daha sonrasında da liyakat ilkesinin
anlamı ve hukuksal çerçevesi ulusal ve uluslararası düzenlemelerden
hareketle irdelenecektir.
According to the Constitution of Republic of Turkey (Art. 70),
“Every (Turkish citizen) has the right to enter public service. No criteria
other than the qualifications for the office concerned shall be taken into
consideration for recruitment into public service.” It refers to merit-based
system of recruitment. Being opposite of the spoils system, the merit
system is the process of promoting and hiring government employees
based on their ability to perform a job, rather than on their political
connections. From the legal point of view, all civil service systems should
be based on merit and the desire to create a nonpartisan government
service. In merit-based system, all appointments and promotions to
positions in the classified service shall be made solely on the basis of
merit and fitness demonstrated by a valid and reliable examination or
other objective evidence of competence. Such appointments and
promotions shall provide fair and equal opportunity without regard to
race, religion, gender, marital and family status and such other criteria as
determined by Law. As it can be seen, merit concept refers to the closest
possible match between the “needs of the organization” and the
knowledge, skills, abilities, experience and personal attributes of a
candidate. Despite its importance, the meaning of the the “merit principle” remains highly contested. In this article, an attempt is made to review the
right to enter public service and to disaggregate different meanings of the
merit concept and its legal framework in naitonal and international
context.
