Adından da anlaşılacağı üzere “Deniz Çevresinin Petrol ve Diğer
Zararlı Maddelerle Kirlenmesinde Acil Durumlarda Müdahale ve
Zararların Tazmini Esaslarına Dair Kanun”, hem kirlenmeye karşı acil
durumlarda müdahale, hem de oluşan zararlar dolayısıyla hukuki
sorumluluk ve tazminat esaslarını düzenlemeyi amaçlamaktadır.
Çalışmamızda, öncelikle denizlerin gemiler tarafından kirletilmesi
sebebiyle hukuki sorumluluğa dair mevzuat ortaya konulmaya
çalışılmıştır. Bilahare, Kanun’un hukuki sorumluluk ve tazminat
hükümleri, ayrıntılı olarak incelenmiştir. Kanun’un, 1992 HSS ve 1992
FS’lerinin bir uygulama kanunu olmadığı saptanmıştır. Keza, Kanun,
müstakil ve kendine özgü bir hukuki sorumluluk sistemi oluşturmamıştır.
Kanun’un asıl hareket noktası ve odağındaki konu, acil müdahale ve
hazırlıklı olmadır. Hukuki sorumluluk ve tazminat meselelerinin acil
müdahale ile birlikte düzenlenmesi isabetsiz bulunmuştur. İncelememizde
Kanun’un uluslararası hukukla uyumlu olmadığı tespit edilmiştir. Ayrıca,
Kanun çok sayıda belirsiz hüküm içermektedir ve sistematiği bozuktur.
Dolayısıyla, Kanun’un uygulanmasında bir hayli sorun yaşanacağı
kuvvetle muhtemeldir. Sonuç olarak Kanun’un kapsamı, acil müdahale ile sınırlı tutulmalı ve denizlerin gemiler tarafından kirletilmesi sebebiyle
hukuki sorumluluk ve tazminata dair hükümler Kanun’dan çıkartılmalıdır.
As is understood from it’s name, The Act on Principles of
Intervention in Urgent Cases of Pollution of the Sea Environment by Oil
and Other Noxious Items and Compensation for Damage aims at both
regulating principles of intervention in urgent cases against pollution and
civil liability and compensation for damage took place. In my study, it
was first tried to introduce legislation concerning civil liability for
pollution of seas by vessels. Later, the Act’s civil liability and
compensation terms were analysed in detail. It has been established that
the Act isn’t any application act of 1992 CLC and 1992 FC. Likewise, it
hasn’t constructed any substantive and original civil liability regime. The
Act’s original starting point and focus topic are urgent intervention and
preparedness. It is identified that civil liability and compensation matters
have been regulated together with urgent intervention is inappropriate. In
my study, it is establihed that the Act isn’t consistent with international
law. Moreover, the Act includes a lot of ambiguous terms and it’s system
is disordered. Accordingly, it is highly probable that many problems
would be exprienced in application of the Act. In conclusion, the scope of
Act should be limited with urgent intervention, and it’s terms concerning civil liability and compensation for pollution of seas by vessels should be
removed from it.
