İlâmsız icrada borçlunun ödeme emrine yaptığı itiraz nedeniyle
duran takibi canlandırmak isteyen alacaklı itirazın iptali davası açabilir.
Bu davada davalı, yani borçlu itirazında haksız görülürse itirazı iptal
edilir; ayrıca, alacaklının talebi üzerine icra inkâr tazminatına mahkûm
edilir. Borçlunun itirazının haksız olduğunun tespitinde başvurulan birinci
kriter alacağın likit olup olmadığıdır. Alacak likit ise kural olarak
borçlunun itirazı haksız sayılır. Borçlunun itirazının haksız olup olmadığı
belirlenirken yardımcı bir kriter olarak dürüstlük kuralına da (Türk
Medeni Kanunu m. 2) başvurulabilir. Borçlunun haksızlığı belirlenirken
somut olayın koşulları dikkate alınmalıdır. Borçlunun itirazının haksızlığı
net bir şekilde ortaya konulamıyorsa borçlu icra inkâr tazminatına
mahkûm edilmemelidir.
During the enforcement proceeding without a judgement, it is
possible for the claimant to restart the enforcement proceeding that
stopped because of the debtor’s objection to the order of payment, by
bringing the nullity of objection suit. In this lawsuit, if the respondent that
is to say debtor’s objection is found unjust, the objection is nullified; besides the debtor is condemned to pay execution denial indemnity on
claimant’s demand. The first criterion to determine whether debtor’s
objection is unjust is to ascertain if the debt is liquid. If the debt is liquid,
the debtor’s objection is deemed unjust, in principle. As an acessory
criterion, the rule of good faith (Turkish Civil Code Art. 2) can also be
applied. When determining whether the debtor’s objection is unjust, the
circumstances of the concrete case should be considered. If the unjustness
of debtor’s claim cannot be established clearly, the debtor should not be
condemned to pay execution of denial indemnity.
