Makalede Türkiye’nin anayasal gelişim sürecinde bugüne kadar
uygulanan hükümet sistemleri incelenmektedir. Her ne kadar 1921 ve
kısmen de 1924 Anayasası döneminde meclis hükümeti sistemi
uygulanmış olsa da 1876 Anayasasıyla birlikte hukuken ağırlıklı olarak
parlamenter rejim veya ona benzer bir yönetim biçimi tercih edildiğinden
araştırmanın ana konusunu parlamentarizm teşkil etmektedir. Yeni
anayasa tartışmaları bağlamında AK Partisi, hükümet istikrarsızlıklarını
gerekçe göstererek parlamenter rejime karşı başkanlık sistemini tavsiye
etmektedir. Makalede, demokrasi açığı ve hukuk devleti eksikliklerini
gidermeden, ideolojik düzenlemelere son vermeden ve askeri-bürokratik
vesayeti ortadan kaldırmadan farklı bir hükümet sisteminin kabul
edilmesinin yönetimde arzu edilen istikrarın sağlanamayacağı gibi siyasal
sorunlara da çözüm bulunamayacağı tezi savunulmaktadır.
This article examines the governmental systems implemented so far
in Turkey’s constitutional development.
Although” contrat de majorite” system was being applied in the
constitution of 1921 and 1924 partially, starting from the Constitution of
1876 a parliamentary or alike system was preferred thus the main topic of
the research is parliamentarism.
In the context of recent constitutional debates the AK Government
proposes the presidential system by referring to the instabilities of the
parliamentary regime. This article defends the thesis that without
overcoming the deficiencies of lack of democracy and rule of law, without
ending ideological regulations and without ending military-bureaucratic
guardianship; adopting a different system will not provide the desired
consistency in administration and will not find a solution to political
problems.
