Roma Devleti'nde, deniz ticareti son derece büyük önem arz etmiş,
bu nedenle, hukuk metinlerinde, deniz taşımacılığına ilişkin hükümlere
oldukça geniş bir şekilde yer verilmiştir. Gemi işletenlerin
sorumluluğunun esas dayanağını locatio conductio operis (istisna
sözleşmesi) oluşturmaktadır. Ne var ki, bu sözleşmeden kaynaklanan
sorumluluk ile preator'lar tarafından tanınan bazı diğer dava haklarının
yetersiz kalması üzerine, yolcuların ya da iş sahiplerinin bu kişilere
güveninin sağlanması ve böylece gemi işletenlerin de yolcuları
kendilerine çekebilmesi için, yine praetor tarafından receptum adı verilen
bir garanti sözleşmesi tanınmıştır. Başlangıçta, gemi işletenin
sorumluluğu için receptum'un yapılmasına yönelik ifade olan "salvum fore
recipere (malların güvende olacağını üstlenmek)"nin varlığı aranmış olup,
Iustinianus Dönemi'nde, bu şart ortadan kalmış, gemi işletenin
sorumluluğu kanundan kaynaklanır hale gelmiştir. |

Maritime commerce has a great importance in Rome, therefore, in
legal texts, provisions regarding carriage by sea were given large
publicity. The sea carriers' responsibility was based on locatio conductio
operis mainly. However, since the responsibility arising from this contract
and some other rights to suit were inadequate, a guarantee contract was
brought by, again, the praetor, in order to make the passengers or locators trust in them and thus let the sea carriers have the passengers. Initially, the
phrase "salvum fore recipere", which is used for receptum, was required
for the sea carrier to be responsible. In the time of Justinian, however, this
requirement did not existed and the responsibility of the sea carrier had its
source in the law. |
