bir rızai sözleşme değildi. ‘Monogami ilkesi’ Roma hukukunun her
döneminde katı bir biçimde muhafaza edilmişti. Geleneksel Roma
evliliğinde kadın manus altındaydı. Kadın manus’lu evlilik yaptığında,
hak ehliyetini ve malvarlığını kaybederdi. Manus altında bulunan kadının
kocası, onun üzerinde hukuken egemenlik hakkına sahipti. Kadın kamusal
yaşamda görev alamazdı. Kadının konumu İmparatorluk Döneminde

bağımsızlık kazanmıştı. Iustinianus’un Corpus Iuris’inde evliliğin insancıl
hukuk ilkeleri muhafaza edildi.
In Roman law, marriage is bounded by an informal agreement.
However, marriage is not a consensual contract. The principle of
monogamy was strictly maintained by every period of Roman laws. Under
the traditional Roman marriage, the woman was in manu maritii. When
the wife was in manu maritii, she would lose the right of having any
property of her own. Where the wife was in manu, the husband has legal
power over her. The woman could not serve in public life. The status of
the woman began to be questioned in the Imperial period and during this
period, women have gained significant legal independence. In
Justinianus’ Corpus Iuris, the principles of the humanistic law of
marriage were maintained.
