Temel hak ve özgürlükler, geçmişten günümüze kadar sürekli
gelişme göstermiş ve bunları kazanmak hiç de kolay olmamıştır. Önceleri
sadece yaşam hakkının korunabilirliği sorgulanırken, hukuk geliştikçe
temel hak ve özgürlüklerin uygulama alanı da genişlemiştir. Bunun bir
sonucu olarak da, bir kişinin istemediği bir işte, ayrılması halinde ceza
tehdidi ile karşı karşıya kalarak zorla çalıştırılmasının temel hak ve
özgürlüklerle bağdaşmayacağı anlaşılmıştır. Sonrasında, hem uluslararası
insan hakları belgelerinde hem de Anayasamızda bu konuda
düzenlemelere gidilmiştir. Ancak ülkemizde devletin en önemli güvenlik
gücü olan Türk Silahlı Kuvvetleri bünyesinde görev alan subay ve
astsubaylar için öngörülen zorunlu ve alternatifsiz 10 yıllık çalışma
süresinin, bu mesleğe başlayan ancak çeşitli nedenlerden dolayı daha
sonra mesleğe devam etmek istemeyen personel için zorla çalıştırma
yasağı kapsamında değerlendirip değerlendirilemeyeceği üstünde ayrıca
düşünülmesi gereken bir konudur. Araştırmalarımıza göre, gerek Avrupa
İnsan Hakları Mahkemesi, gerekse Anayasa Mahkemesi önüne konunun
bu boyutu ile ilgili bir dosya gelmemiştir. Ancak bu yargı yerlerinin zorla
çalıştırma yasağına ilişkin diğer içtihatları göz önünde bulundurularak, bu
çalışmada, Zorla Çalıştırma Yasağı, subay ve astsubaylar açısından ele
alınacaktır.
Fundamental rights and freedoms, have been developing
continuously since past to present and it has not easy to obtain these.
While formerly, only protectionability of right of life has discussed, with
the developing of law, application area of fundamental righst and
freedoms have become more expanded as well. As a result, it has
understood that forced to run anybody in a jop he / she does not like by
threat of punishment is incompatible with the fundamental rights and
freedoms. Than, there have been some arregements about this subjeckts
both international legal documents and our constitution. However, it must
olso be considered whether the 10 years mandatory study time which is
obligatory and non – alternatively and predicted for officers and NCOs’
can be evaluated in prohibition of forced to run or not for the personal in
Turkish Army Forces who started this job and don’t want to keep on this
career becouse of any of the reason. Acording to our researchs, there are
any fail especialy about this subject both The European Court Of Human
Rigths and Turkish Constitution Court. But, with considering the case
law, which have connected to decision by these courts, in this study,
prohibition of forced to run will be handled from the point of view the
officers and petty officers.
