Çalışmamızda, suçun özel görünüş şekillerinden olan teşebbüsün,
hırsızlık suç tipinde nasıl gerçekleştiği Yargıtay kararları ışığında ele
alınmıştır. Teşebbüs kurumunun sahip olduğu çeşitli teorilerin çalışma
kapsamı genişletilmeden kısmen de olsa eleştirel boyutta tartışılmaya
çalışıldığı çalışmamızda; Yargıtay’ın, failin hırsızlık konusu mal üzerinde
ne zaman egemenlik kurduğuna ölçüt olarak “kesintisiz takip” ölçütünü
belirlemiş olduğu tespit edilmesinin yanında Yargıtay’ın kendi içinde,
hırsızlık suçunda hazırlık hareketleri ile icra hareketlerinin birbirinden
ayrılması konusunda nasıl fikir ayrılığına düştüğü üzerinde durulmuştur.
This study looks at how attempt, as a manifestation of crime, occurs
in the crime of larceny in the light of Yargıtay decisions. It aims to discuss
various theories on the concept of attempt in a partially critical manner
without further elaboration and focuses on the way Yargıtay considers
“hot pursuit” a criterion for determining when the perpetrator takes
possession of stolen goods as well as the internal disagreement of
Yargıtay on the separation of the preparation and the caption processes
within the crime of larceny.
