Bu çalışmanın konusu “Bilirkişilik Kanun Tasarısı Taslağı
Hakkında Bazı Tespitler”dir. Çalışmada, Adalet Bakanlığı Sitesinde
yayımı yapılan Bilirkişilik Kanunu Tasarısı Taslağı incelenmiştir. Söz
konusu Taslak’ta, bilirkişilik ile ilgili temel düzenlemeler yer almaktadır.
Etkin ve verimli bir kurumsal yapı oluşturulmak amacıyla hazırlanan
Taslak, bilirkişilerin nitelikleri, eğitimi, seçimi ve denetimine ilişkin usul
ve esasların yer aldığı 20 maddeden oluşmaktadır. Bu kapsamda,
öncelikle Taslak hakkında genel bilgiler sunulup, Taslağın sistematik
yapısı hakkında açıklamalar yapılmıştır. Ardından Taslağın muhtevası
hakkında maddeler halinde değerlendirmelerde bulunulmuştur. Nihayet
genel kanaatimize ise, “Sonuç” kısmında yer verilmiş ve çalışma
tamamlanmıştır.
The subject of this article is “Some Determinations in relation to
The Draft Bill regarding Expertise”. The Content in the Draft Bill which
was published on the web site of the Turkish Ministry of Justice, has been examined. The said draft contains basic regulations about expertise. The
Draft was primarily prepared with the aim of providing an active and
efficient institutional structure, is made up of 20 Articles which deal with
qualification, education, selection and inspection of expertise. In this
context, firstly, an over-all information about the Draft Bill is presented.
Then the general contents of the Draft is set out. Finally our general
opinion is placed in the “Conclusion.”
