Çekişmesiz yargı işleri için görevli ve yetkili mahkeme, özel hükümler saklı
kalmak kaydıyla, 6100 Sayılı Hukuk Muhakemeleri Kanunu’ndaki ilgili hükme göre
belirlenir. Hukuk Muhakemeleri Kanunu’nda çekişmesiz yargı işleri için belirtilen görev
ve yetki kuralı özel kanunlarda aksi öngörülmedikçe uygulanacaktır. Kanunlarda özel
hüküm bulunan hallerde ise özel hükümde yazılı olan mahkeme, o çekişmesiz yargı işi için
görevli ve yetkili olacaktır. Ayrıca bazı çekişmesiz yargı işleri mahkemeler dışında başka
makamlara da verilmiştir.
Without prejudice to the special provisions for non-contentious jurisdiction,
competent and local competent courts in non-contentious jurisdiction are determined by
provisions of Civil Procedure Code Numbered 6100. The provision regarding competence
and venue in Civil Procedure Code is applied unless otherwise provided by special law. If
there is an existance of specific provision regarding jurisdictional competence and venue,
the court according to special provision will be competent and local competent court. Also,
there are also some non-contentious judicial affairs have also been given to other
authorities outside the courts
