ABSTRACT
Any medical intervention is considered per se as a violation of the absolute rights
of the patient such as life, health and body integrity that everyone should respect. In order
to avoid any violation, informed consent of the patient is required because the patient has
the right of self determination. It is crucial that the patient is enlightened by the physician
about the diagnosis, suggested treatment, potential risks and probable costs of this
treatment and alternative methods. Otherwise, even in the benefit of the patient, civil or
criminal responsibility of the physician may arise from the intervention because of the lack
of informed consent. However, in some cases, by virtue of superior private interest of the
patient or because of superior public interest, it is exceptionally not required for the
physician to wait for any consent of the patient. If the consent of the patient doesn’t
comply with his/her absolute rights, this consent is illegal.
