Amaç: Günümüz toplumları içerisinde obezite her geçen gün artmakta ve çağımız insanlarını tehdit eden bir unsur haline gelmektedir. Çalışmamızda, gerek obez bireylere gerekse de diğer bireylere uygulanan tıbbi müdahaleler ele alınmış, bu kapsamda meydana gelen zararların yargıya taşınan kısmı incelenmiş, yargı kararları çerçevesinde hekime ve hastaya düşen ödevler belirlenerek hekimin ve hastanın sorumluluk alanı incelenmiştir. Materyal ve Metot: Çalışmamızda toplamda 40 (kırk) adet yargı kararı incelenmiştir. Bu kararların 10 (on) tanesi obez bireylere uygulanan tıbbi müdahalelere ilişkin iken kalan 30 (otuz) tanesi diğer bireylere uygulanan tıbbi müdahalelere ilişkindir. Bulgular: İncelenen 40 (kırk) adet yargı kararının obez bireyler ve diğer bireyler olarak ayrımı yapılmıştır. Akabinde; cezai sorumluluk, hukuki sorumluluk ve idari sorumluluk olarak üç başlık altında incelenmiştir. Sorumluluk türleri alt başlıklarında; tıbbi müdahalenin gerçekleştiği hastane türü, müdahalenin aşaması, malpraktis - komplikasyon ayrımı, Adli Tıp Kurumu kararlarının hükme etkisi, bozma ve onama sayıları sayısal veri olarak sunulmuştur. Sonuç: Tıbbi müdahale neticesinde, zararın malpraktis olması durumunda sorumluluğun meydana geldiği, komplikasyon halinde ise komplikasyon yönetiminin sorumluluğa etki ettiği anlaşılmıştır. Adli Tıp Kurumu raporlarının hükme doğrudan etki ettiği, obez bireylere uygulanan tıbbi müdahalenin sonuçlarından doğan sorumluluk ile diğer bireylere uygulanan tıbbi müdahale sonuçları arasında paralellik olduğu, hekimin ödev ve sorumluluklarını belirleyen bir malpraktis yasasına ihtiyaç bulunduğu anlaşılmıştır. Aim: Obesity that very common in today's societies is becoming a threat against people's health. In this study, the occurrence of obesity and it's effects on people are examined. In this content, Medical treatments were analyzed on people who obese and don't. Some medical applications caused damages on patients and some of them was submitted to the courts. Hereby, the rules that patient's and doctor's has to obey were examined and classified according to the court decisions. Material and Method: In total 40 of judicial decision examined, while 10 of them related to medical interventions that applied on obese persons and 30 of them related to medical interventions applied on other people. Results: These decisions classified according to the obese people and other people. Subsequently, 3 types of liability have been determined: Criminal, Legal and Administrative Liability. Sort of hospital that medical intervention, phase of intervention, malpractis, complication distinction and The effect of Forensic Medicine İnstitution's decisions on the provisions are presented as data. Conclusion: To conclude, medical interventions liability occurs when the intervention is malpractis. The way how treated the complication is required liability, too. Forensic Medicine İnstitution reports have direct effects on to the provisions. Additionaly, it was determined similarity between results of medical interventions that applied on obese people and other people. Because of this, it is understood that should be a law about determining the duties and responsibilities of doctor. Key Words: Malpractis, obesity, obesity surgery, juridical decisions.
