Özet
Öz:Demokratik toplumlarda halk, kendisi adına temsil görevini yürütmesi için vekiller tayin eder. Bu vekiller de halk adına temsil görevini yerine getirir ve kararlar alır. Demokrasi rejiminin ana çerçevesi olan bu sistem belli kurallara tabidir. Seçme ve seçilme hakkı için bir takım kurallar öngörülmüştür. Temsil konusu, hayati önemi haiz olduğu için toplum menfaatleri ön planda tutulmuştur. Bu makalenin konusu seçilme yeterliliğidir. Ana kural olan 1982 Anayasası’nın 76’ıncı maddesi ve ilgili diğer mevzuat ışığında konu ele alınmıştır. Seçilme şartları tek tek ele alınmış, genel nitelikteki açıklamalar yapılmış ve sonrasında konuya ilişkin Yüksek Seçim Kurulu kararlarına da yer verilmiştir. Bunun yanı sıra Anayasa Mahkemesi, Yargıtay ve Danıştay kararlarına da yer verilmiştir. Konu sadece içi hukuk yönünden ele alınmamış, mukayeseli hukuktaki durum da incelenmiştir. İnceleme için ülkeler tercih edilirken farklı bölgelerden olmasına özen gösterilmiştir. Ancak Avrupa’daki demokrasi kültürü nazara alınarak yol gösterici olması amacıyla Avrupa örnekleri zengin tutulmuştur. Konuyu ilişkin olarak sorunlu alanlar tespit edilmiştir. Bu sorunlara ilişkin olarak da çözüm yöntemleri önerilmiştir.
Abstract:In democratic societies the public elect deputies to represent them. These representatives carry out this duty and make decisions on behalf of the public.This system, which is the main framework of the regime of democracy, is subject to certain rules. Some rules have been regulated giving the right to vote and be elected. The issue to represent is vital for these societies and therefore is at the forefront. The subject of this paper is the eligibility to be elected. This issue is dealt with in the context of the main rule of article 76 of the 1982 Constitution and other relevant rules (laws, statutes,regulations etc.). Eligibility requirements and general definitions are outlined and the decisions of the Supreme Electoral Council are given in relation to this issue.In addition, the decisions of the Constitutional Court, the Supreme Court and the Council of State are mentioned. Topics are dealt with, not only in terms of domestic law but also in comparative law. Countries have been carefully selected from various zones. However, taking into consideration the culture of democracy in Europe, European examples are used more for guidance than others. Problematic areas have been identified in relation to the issue. With regard to these problems, the solution methods are proposed.
