Özet
Öz:Resmi sicil, içeriği hakkında, ilgisi ve menfaati olan kişilerin bilgi edinmelerini sağlayan ve resmi memurlar tarafından tutulan kayıtlardır. Resmi senetler ise, kanun veya tarafların iradesiyle resmi şekle bağlanan, resmi görevli kişiler tarafından kanunda belirtilen şekle uygun olarak düzenlenen senetlerdir. Medeni Kanun m.7 hükmü, resmi sicil ve senetlerin doğruyu yansıttığı konusunda bir karine kabul etmiş ve bu karinenin aksinin her türlü delille kanıtlanmasına olanak sağlamıştır. Ancak Medeni Usul Hukuku Kanunu m.201 hükmü, senede karşı senet mecburiyeti getirmiştir. Ayrıca aynı Kanun m.204 hükmü, ilamlarla noterler tarafından düzenlenen senetleri, sahtelikleri ispat olunmadıkça, kesin delil saymış ve bu suretle resmi sicil ve senetlerin içeriğinin doğru olmadığının ispatı hususunda Medeni Kanun m.7/II hükmü ile getirilmiş bulunan delil serbestisi daraltılmıştır. İsviçre’de federal nitelikte bir medeni usul hukuku kanunu 2011 yılından beri vardır. Ayrıca, İsviçre’ de taraflar arasında bir eşitlik sağlamak amacıyla, karinenin aksini ispatlayacak tarafa, resmi sicil ve senetlerin doğru olmadığını her türlü delille ispat etme imkanı verilmiştir. Bu nedenle, ülkemizde başka kanun hükümleri ile aksini ispata getirilmiş olan kısıtlamalar, MK.m. 7 hükmünün ruhu ve amacı ile bağdaşmamaktadır.
Öz:Official registers are records that are kept by public officials and pro-vide information about the contents of the information to the interes-ted persons. Official bills, on the other hand, are the bills which are bound to the official form by the law or the will of the parties and issued by the official persons in accordance with the form specified in the law. The provision of Article 7 of the Civil Code adopted a pre-sumption that the official registers and bills reflect the truth and pro-vided that the opposite of this presumption may be proved by all kinds of evidence. However, the provision of Civil Procedure Law article 201 has brought the obligation to counter-bill. In addition, the provision of Article 204 of the same Code, has considered, the deem or bill which are issued by notary publics, as definitive evidence unless their falsifications were proved, and thus the freedom of evi-dence brought with the provision of Article 7 /II of the Civil Code has become narrowed. A federal civil procedure law exists in Switzerland since 2011. Furthermore, in Switzerland, by this regulation, the party who will prove the opposite of the presumption accepted by law is given the opportunity to prove by any evidence that the official registers and notes are not correct for the sake of convenience. Therefore, the restrictions brought by other rules of Act which narrow the opportu-nity of proving by any evidence in our Country, is incompatible with the spirit and purpose of the provision 7 of the Civil Code.
