ÖZET Çalışmamızın konusu, ilk kez suça sürüklenen çocuklar bakımından öngörülen ve 2005 yılında Çocuk Koruma Kanunu ile Türk Ceza Mevzuatına giren hükmün açıklanmasının geri bırakılması kurumudur. Hükmün açıklanmasının geri bırakılması; sanık hakkında hükmedilen mahkumiyet kararının denetim süresi boyunca açıklanmaması, bir diğer deyişle askıya alınması anlamına gelmektedir. Çalışmamızın ilk bölümünde hükmün açıklanmasının geri bırakılması kavramını, kurumun tarihsel gelişimini, hukuki niteliğini ve benzer kurumlardan farkını inceleme konusu yaptık. İkinci bölümde Ceza Muhakemesi Kanunu'nda düzenlenen kurumun uygulanma şartlarını tüm yönleriyle ele almaya çalıştık. Çalışmamızın üçüncü bölümünde, hükmün açıklanmasının geri bırakılması kararı verilmesinin meydana getirdiği sonuçları ve son bölümde ise hükmün açıklanmasının geri bırakılması kararına karşı gidilebilecek kanun yollarını inceledik. Bu çalışmanın amacı, Türk Ceza Mevzuatına girdiği günden bu yana sıklıkla uygulanan ve mahkemeler tarafından uygulanma oranı günden güne artan hükmün açıklanmasının geri bırakılması kurumunu, Yargıtay kararları ve doktrindeki farklı görüşler ışığında etraflıca incelemektir. ABSTRACT The object of our study is the institution of the deferment of the announcement of the verdict which is provided for the children who are drawn into crime for the first time and was incorporated into the Turkish Penal Legislation in 2005 by the Child Protection Law. The deferment of the announcement of the verdict means that the conviction for the defendant is not announced during the probation period, in other words, the sentence is suspended. In the first part of our study, we examined the concept of the deferment of the announcement of the verdict, the historical development of this institution, its legal nature, and its difference from similar institutions. In the second part, we tried to cover all aspects of the conditions of implementation of the institution which is regulated in the Code of Criminal Procedure. In the third part, we examined the results generated by the ruling to defer the announcement of the verdict and in the last section, we examined the legal remedies that can be pursued against the ruling to defer the announcement of the verdict. This study aims at examining the institution of the deferment of the announcement of the verdict, which has been applied frequently since its incorporation into the Turkish Penal Legislation, and whose enforcement rate by the courts is increasing day by day, in the light of the Supreme Court's decisions and of different doctrinal opinions.
