Kolluk şikâyet ve gözetim sistemi ve Türkiye için kolluk gözetim kurumu (Kolluk ombudsmanlığı) önerisi

Abstract

Kolluk kuvvetlerine kişilerin temel hak ve özgürlüklerine müdahale niteliği taşıyan birtakım özel yetkiler verilmiştir. Bununla birlikte söz konusu yetkilerin kullanılırken kanuna dayanması, temel hak ve özgürlüklerin özlerine dokunmaması, amaca uygun kullanılması ve ölçülü olması önem arz etmektedir. Kolluk kuvvetlerinin denetlenmesi noktasında birtakım kurum içi mekanizmalar bulunsa da etkili bir denetimin ancak bağımsız ve tarafsız birimlerce sağlanabileceği bir gerçektir. Bu sebeple yasama, yürütme ve yargı erkleri; mülki amirler; bağımsız kurullar; sivil toplum örgütleri ve medya tarafından yapılacak sivil denetimler ön plana çıkmaktadır. Etkili kolluk hizmetleri, özgür ve demokratik bir toplumun temel taşı niteliğindedir ve kolluk hizmetlerini denetleyecek olan birim bu hizmetten doğrudan yararlanan halktır. Kolluk personelinin hak ihlali doğuracak eylem ve işlemlerine yönelik şikâyetleri ele alacak bağımsız mekanizmaların bulunması vatandaş, toplum ve kolluk teşkilatı nezdinde önemli faydalar sağlamaktadır. Hak ihlaline uğrayanlar kolluk teşkilatları dışında şikâyetlerini iletebilecekleri bir merciye kavuşmakta, kolluk personelinin hesap verebilirliğinin sağlanmasına katkıda bulunulmaktadır. Kolluk teşkilatları şikâyetleri daha etkili bir şekilde ele almakta, şikâyet sürecinde şeffaflık artmaktadır. Kolluk teşkilatı ve toplum arasındaki artan iletişim toplumsal ilişkileri geliştirmektedir. Kolluk politikalarına yönelik öneriler sayesinde aksayan hususlar giderilmekte, yargının iş yükü azalmaktadır. Bu bağlamda, çalışmada, kolluk kuvvetlerine yönelik şikâyetleri soruşturacak bağımsız, tarafsız ve sivil bir şikâyet mekanizması oluşturulması niyetiyle kurulan Kolluk Gözetim Komisyonu'nu seçilmiş ülkelerdeki emsalleri ile yetki, kaynak, bağımsızlık, şeffaflık ve raporlama, siyasi destek ve sivil toplum katılımı gibi birtakım kriterler doğrultusunda karşılaştırmak, güçlü/zayıf yönlerini ortaya koymak ve sisteme ilişkin birtakım öneriler sunmak amaçlanmaktadır. Komisyon'un kuruluşu sivil gözetime gösterilen önem açısından son derece olumlu olmakla birlikte, sistemin etkililiğini artıracak birtakım reformlara ihtiyaç olduğu görülmüş, Türkiye için Kolluk Gözetim Kurumu modeli önerisinde bulunulmuştur.

Law enforcement officers have been given a number of special authorities that interfere with the fundamental rights and freedoms of individuals. However, it is important to note that the law enforcement agencies should abide the law by using their authority in an appropriate and proportional way and not touch the essences of fundamental rights and freedoms. Although there are several internal mechanisms for auditing law enforcement, it is a fact that an effective audit can only be provided by independent and impartial units. For this reason, not only the civilian control of the legislature, executive and judiciary and administrative authorities but also independent boards, non-governmental organizations and the media comes to the fore. Effective and efficient law enforcement services are the cornerstone of a free and democratic society, and the unit that will control the law enforcement services is the people directly benefiting from this service. The existence of independent mechanisms to handle complaints about law enforcement personnel's actions and procedures that cause violations of rights provides important benefits for the citizens, society and law enforcement agencies. Those who have been subjected to violations of rights have a body where they can submit their complaints outside the law enforcement agencies and contribute to ensuring accountability of law enforcement personnel. Law enforcement agencies handle complaints more effectively, and transparency increases in the complaint process. Increased communication between the law enforcement agencies and the community improves social relations. Thanks to the recommendations for law enforcement policies, disruptive issues are eliminated and the workload of the judiciary is reduced. In this context, this study aims to compare the Law Enforcement Oversight Commission which was established with the intention of having an independent, impartial and civil complaint mechanism to investigate complaints against law enforcement officers with its counterparts in selected countries. It is expected that the criteria including authority, resource, independence, transparency and reporting, political support and civil society participation will help to imrove the system by revealing its strengths and weaknesses. Although the establishment of the Commission is extremely positive in terms of the importance given to civilian oversight, reforms are needed to increase the effectiveness of the system. In this respect, this study proposes a Law Enforcement Oversight Agency model for Turkey.
