İnsan haklarının bölgesel örgütler eliyle korunup güçlendirilmesi
açısından Avrupa Konseyi, Amerikan Devletleri Örgütü ve Afrika
Birliği’nin çalışmaları dikkat çekmektedir. Bu çalışmada Amerikalılar
arası sistem ele alınarak, sistemin işleyişi açıklanmaya çalışılmıştır. Bu
bağlamda öncelikle, çalışmanın konusunu teşkil eden Amerikalılar arası
insan hakları sistemi açısından 3 farklı seviyenin bulunduğunu baştan
ifade etmek gerekir. İlki, Amerikan Devletleri Örgütü’ne üye devlet
vatandaşları açısından Amerikalılar Arası İnsan Hakları Komisyon’u
eliyle Amerikan İnsan Hak ve Ödevleri Bildirisi’nden ve Örgüt Şartı’ndan
kaynaklanan haklara ilişkin olarak minimal koruma sağlanmasıdır. İkinci
seviyede ise Amerikalılar Arası İnsan Hakları Sözleşmesi’ne taraf olup da
Amerikalılar Arası İnsan Hakları Mahkemesi’nin yetkisini kabul etmeyen
devletler bulunmaktadır. Üçüncü seviyede ise hem Sözleşme’ye taraf
olan, hem de Mahkeme’nin yetkisini kabul eden devletler bulunmaktadır1

Çalışmada öncelikle Amerikan Devletleri Örgütü hakkında genel
bilgiler verilmiş ve Örgüt çatısı altında kabul edilen insan hakları
belgelerine ilişkin kısa açıklamalar yapılmıştır. Sonrasında ise
Amerikalılar arası insan haklarını koruma mekanizmalarından
bahsedilmiş; Amerikalılar Arası İnsan Hakları Komisyonu ile
Amerikalılar Arası İnsan Hakları Mahkemesi’nin işleyişi ele alınmıştır.
In the context of protection of human rights by regional
organizations, the works of the European Council, Organization of
American States and African Union constitute salient examples. This
study examines the Inter American System and its mechanism. Primarily,
it must be known that there are three level of protection under the
framework of this system. First one is minimal protection provided by the
Inter-American Commission on Human Rights related to the rights arising
from The American Declaration of the Rights and Duties of Man and the
Charter of the Organization of American States. On the second level there
are states which have ratified The American Convention on Human Rights
but haven’t recognized the jurisdiction of the Inter-American Court of
Human Rights. Lastly, the states which have ratified The American
Convention on Human Rights and recognized the jurisdiction of the InterAmerican
Court of Human Rights generate the third level.
This study begins with the general information about the
Organization of American States and the human rights instruments
accepted under the framework of this organization. Then, protection
mechanisms of the system and operation of both of the Inter-American Commission on Human Rights and the Inter-American Court of Human
Rights are mentioned. In this context, knowledge about the Commission’s
and the Court’s composition, application requirements, procedures before
the Commission and the Court and the other activities of the Court are
explained. Moreover, the differences between American and European
systems are discussed in some matters. In the conclusion part, the
deficiencies of the system and recommendations are provided by
evaluating the system generally.
