Özet
Bu çalışmada İslam hukukunda toplumsal güvenin tesisinde kamu ve özel hak ihlalleri neticesinde öngörülen cezalar incelenmiştir. Bu itibarla güven sarsıcı ve yıkıcı suçlar olan kasten adam öldürme, zina, iffete iftira, hırsızlık/sirkat, terör/hirabe gibi suç ve cezalar ele alınmıştır. Bunun yanında toplumsal refahı tesis etme adına İslam'ın temel rükünleri olan oruç ve hac ibadetlerinde oluşan ihlaller neticesinde öngörülen cezalar da işlenmiştir. Çalışma giriş ve üç bölümden oluşmaktadır. Giriş bölümünde araştırmanın amacı, önemi ve araştırmanın sınırları ele alınmıştır. Birinci bölümde toplumsal güvenin önemi, toplumsal güvenin birimleri ve toplumsal güvenle ilişkili kavramlar irdelenmiştir. İkinci bölümde toplumsal güvenin dayanakları ve dış güvenlik konusu ele alınmıştır. Üçüncü bölümde ise toplumsal güvenin tesisinde İslam hukukunun rolü, İslam hukukunun güven hususunda işleyişi, toplumsal güveni sarsan yapılanmalar, bu yapılanmalara karşı hukukî önlem ve cezalar ele alınmıştır.
In this stuy, the penalties for public and private rights violations in the establishment of social trist in Islamic law were examined. In this respect, crimes and punishments such as manslaughter, adultery, slander of chastity, theft/stealing, terrorism/treason, which are crims that are shocking and destructive, are discussed. In addition, the penalties envisaged as a result of violations of fasting and hajj prayers, which are the basic pillars of Islam, were also committted in order to establish social wellbeing. The study consists of an introduction and three parts. In the introduction part, the purpose, importance and limits of the research are discussed. In the first part, the importance of social trust, the units of social trust and the concepts related to social trust are examined. In the second part, the foundations of social trust and external security are discussed. In the third chapter, the role of Islamic lav in the establishment of social trust, the functionnıng of Islamic law in terms of trust, the structures that undermine social trust, the legal measures and penalties against these structures are discussed.
