Özet
Dilencilik günlük yaşamda sık karşılaşılan bir sosyal sorundur.
Modern toplumlarda dahi, yaygın bir biçimde görülmektedir. Günümüzde
dilencilik, bireysel ahlaki kötülük olmaktan çıkıp, kadim bir meslek haline
gelmiştir.
Dilenciliğin, ekonomik, sosyal, kültürel pek çok sebebi
bulunmaktadır. Bu sebepler ortadan kaldırılmaksızın dilencilikle
mücadele edilebilmesi mümkün değildir. Türk Hukuku’nda dilencilik
eylemi ile hukuki alanda mücadele amacıyla iki farklı düzenleme
getirilmiştir. Bunlardan ilki, dilencilik kabahati; ikincisi ise dilencilik
suçu.
Dilencilik suçu ile, dilencilik kabahatini ayıran husus, dilencilik
kabahatinde bireysel dilenme söz konusu iken; dilencilik suçunda, bir
çocuk veya engellinin dilencilikte araç olarak kullanılmasıdır.
Çalışmamızda, ilk olarak dilenciliğin sosyal, kültüler ve ekonomik
sebepleri ortaya konulacak, daha sonra Türk Ceza Kanunu’nun 229.
maddesinde düzenlenen dilencilik suçu incelenecektir.
Begging is a common social problem in daily life. Even in modern societies, it is ubiquitous. In modern times, it has became an ancient profession from being an immoral act. Begging has several reasons, including economic, social, and cultural. It will not be possible to fight with begging without dealing with these factors. Two different legislations are implemented in the Turkish Law to tackle begging. Firstly, begging as a minor offence. Secondly, begging as a criminal offence. Individiual begging is a minor offence in terms of Turkish Minor Offences Act (Article 33). The crime of vagrancy is regulated within the Turkish Penal Code (Article 229). Both acts are distinguished in terms of begging style. Begging as a minor offence, regulates individual begging. On the other hand, the crime of vagrancy regulates begging via children or disabled people. In our study, We will explain the cultural, social and economic reasons of begging and its impact on society. Hereafter, we will scrutinize to the elements of the crime of vagrancy within the article 229 of Turkish Penal Code.
