Abstract
Türkiye ekonomisinde hayvancılık sektörü önemli bir yere sahiptir. İlerleyen yıllarla birlikte artan nüfus ve iklim değişiklikleri bu sektöre duyulan ihtiyacı artırmıştır. Mera arazileri, hayvancılık sektörünün doğal yem kaynakları içerisinde yer alır. Bu sebeple meraların korunması ve sürdürülebilirliğinin sağlanması önemlidir. 4342 Sayılı Mera Kanunu'nun yürürlüğe girmesinden önce meralara ilişkin hukuksal düzenlemeler yetersiz kalmıştır. Bunun sonucunda meraların sayısı azalmış ve verimi düşmüştür. 4342 sayılı Kanun ile birlikte yasal boşluklar ortadan kaldırılmaya çalışılmış ve meraların korunması, bakımı, ıslahı amaçlanmıştır. Bu çalışmanın amacı, meraların hukuki niteliğini mevcut mevzuat çerçevesinde açıklamak, uygulamada "mera davaları" olarak anılan ve uyuşmazlık konusunun mera olduğu dava türlerini ele almaktır. Çalışmada ilk olarak, meraların idare hukukunda yer aldığı sınıf olan "kamu malları" konusuna yer verilmiştir. Daha sonra ise meralara ilişkin hukuki düzenlemeler ve mera davaları ele alınmıştır. The livestock sector has an important place in the Turkish economy. Increasing population and climate changes in the following years increased the need for this sector. Pastures are among the natural feed resources of the livestock industry. Therefore, it is important to protect and ensure the sustainability of pastures. Before the Pasture Law No. 4342 came into force, legal regulations regarding pastures were insufficient. As a result, the number of pastures decreased and their productivity decreased. Law No. 4342 aimed to protect, maintain and improve pastures by trying to eliminate legal gaps. The aim of this study is to explain the legal nature of pastures within the framework of the current legislation and to address the types of cases called "pasture cases" in practice, where the subject of the dispute is pasture. In the study, firstly, the subject of "public goods", which is the class in which pastures are included in administrative law, is included. Then, regulations regarding pastures and pasture cases were discussed. Key Words: Pasture, Pasture Lawsuits, Pasture Lands, Legal Nature of Pastures, Public Properties.
