dc.description.abstractBu tez, klasik Mu'tezile ilmi geleneğinin son halkası olması bakımından önemli bir şahsiyet olan Hâkim el-Cüşemî'nin usul ilmindeki yöntemini incelemektedir. el-Cüşemî, tefsir, hadis, tarih gibi İslâmî ilimlerin çoğunda önemli çalışmalar yapmış bir isimdir. Özellikle öne çıktığı kelâm ilminde, görüşlerini delilleriyle savunmuştur. Muhaliflerinin görüşlerini sert bir dille eleştirmesi, sonunda öldürülmesine neden olmuştur. Bu tezde, el- Cüşemî'nin fıkıh usulü alanındaki görüşleri bir araya getirilmiş, genel usul yaklaşımlarıyla karşılaştırılmış ve Mutezili gelenek içerisindeki yeri gösterilmiştir. Tez, üç bölümden oluşmaktadır. Birinci bölümde, el-Cüşemî'nin şahsî hayatı, doğumundan ölümüne kadar olan ilmî hayatı, yaşadığı dönemin siyasi, sosyal ve dini durumu, fıkhi ve itikadi mezhebi incelenmiştir. İkinci bölümde, el-Cüşemî'nin İslâm fıkhının ittifak edilen kaynakları kabul edilen Kur'ân, sünnet, icmâ ve kıyas hakkındaki usûlî görüşleri yer almaktadır. Bölümün sonunda, ihtilaf edilen kaynaklar hakkındaki görüşleri ele alınmıştır. Üçüncü bölümde ise el-Cüşemî'nin lafızların delaletleriyle ilgili görüşleri (âm ve has, emir ve nehiy, mücmel ve mübeyyen, nasih ve mansuh, icithad, müfti ve müstafti sıfatları, te'aruz ve deliller arasında tercih) incelenmiştir. Çalışma, ulaşılan önemli tespitlerin yer aldığı sonuç bölümüyle tamamlanmıştır. Anahtar kelime: el-Hâkim, el-Cüşemî, Fıkıh, Fıkıh Usûlü, Mu'tezile, Uyûnu'l-mesâil.
dc.description.abstractThis thesis focused on studying the fundamentalist approach of Al-Hakem Al-Joshame, a distinguished scholar who had a great influence on most Islamic sciences, including the interpretation of the Qur'an, Hadith, and history. He excelled in the science of speech, was strong in debate, and bold in presenting his ideas. His tongue was like a sword in belittling the opinions of opponents, which led to his killing at the hands of his opponents. Therefore, I collected his fundamentalist views in this letter, and divided it into three chapters. In the first chapter . I studied the personality of Al-Hakem Al-Joshame and his academic life from his birth to his death, and I studied the political, social and religious reality of his era and his school of jurisprudence and belief. In the second chapter, Al-Hakim Al-Joshame's basic opinions were presented regarding the agreed-upon sources of Islamic jurisprudence (the Qur'an, the Sunnah of the Prophet, consensus, and analogy). At the end of the second chapter, I mentioned his opinions on disputed sources. At the end of the second chapter, I mentioned his opinions on disputed sources. In the third chapter, I talked about Al-Hakem Al-Joshame's views on fundamentalist semantics (general and specific, command and prohibition, similar and clear, abrogated and abrogated, ijtihad and description of the mufti and the questioner, and conflict and weighting between evidence) and I concluded the research by mentioning the most important results that I reached.
