dc.description.abstractOsmanlı İmparatorluğu, 19. yüzyılın sonlarına kadar büyük ölçüde İslam şeriatına dayalı bir hukuk sistemiyle yönetilmiştir. Ancak, Batı'dan gelen etkiler, imparatorluğun iç ve dış problemleri, ekonomik sıkıntılar ve askeri yenilgiler, Osmanlı'da köklü reformlar yapma gerekliliğini doğurmuştur. Bu bağlamda, Osmanlı'da şeriat temelli hukuk sisteminden modern hukuk sistemine geçiş süreci, Tanzimat Fermanı (1839) ile başlayıp, 19. yüzyılın sonlarına kadar çeşitli adımlarla şekillenmiştir. Tanzimat Dönemi'yle birlikte hukukta modernleşme çabaları, idarî ve toplumsal yapıyı dönüştüren reformlarla paralel ilerlemiştir. Bu süreçte, özellikle "Medeni Kanun" gibi modern düzenlemelerle, halkın farklı dini inançları gözetmeden, devletin tüm vatandaşlarına eşit bir şekilde hizmet vermesi amaçlanmıştır. Ancak, şeriatın hâkim olduğu bir toplumda bu dönüşüm, hem dini hem de toplumsal açıdan güçlü tepkilere yol açmıştır. Osmanlı'da, modernleşme sürecinin en belirgin tepkileri, dini otoritelerden ve muhafazakâr kesimlerden gelmiştir. Hatta, bazı gruplar, bu reformların İslam'a aykırı olduğunu savunmuş ve padişah yönetimine karşı direniş göstermiştir. Bu tezde, Osmanlı'daki hukuk reformları, modernleşme süreci, hukuki dönüşümün toplum üzerindeki etkileri ve bu dönüşüme karşı gösterilen tepkiler incelenmiştir. Bu süreç, Osmanlı toplumunun din ve hukuk anlayışındaki evrimi, modernleşme ile gelen toplumsal değişimleri ve seküler hukukun toplumdaki yeri gibi önemli kavramlar üzerinden analiz edilmiştir. dc.description.abstractThe transition from a Sharia-based legal system to a secular legal framework in the Ottoman Empire is a key aspect of its modernization efforts in the 19th century. Following the Tanzimat reforms of 1839, the Empire sought to reform its legal system in response to internal challenges, external pressures, and the growing influence of Western legal concepts. This process aimed at replacing the traditional Islamic jurisprudence with more secular, codified laws that would treat citizens equally regardless of their religious affiliation. Key milestones in this transformation include the introduction of new civil and commercial codes, inspired by European legal systems, as well as the establishment of secular courts.However, this shift was met with resistance, particularly from religious authorities and conservative segments of society who viewed the reforms as a threat to Islamic principles. Despite these reactions, the legal modernization efforts continued, laying the groundwork for the secular legal system that would later dominate in the early years of the Turkish Republic. This thesis explores the evolution of the Ottoman legal system from Sharia to secular law, examining the social, political, and religious implications of this transition, as well as the reactions it provoked.
