| dc.description.abstract | Bu tez Muhammed b. Hasan eş-Şeybânî'nin Kitâbu'l-Asl isimli eserinde istihsan metodunun nasıl uygulandığını konu edinen bir çalışmadır. Söz konusu eser Hanefî Mezhebinin temel fıkıh kaynaklarından olması sebebi ile önem arz etmektedir. Çalışma üç bölümden oluşmaktadır. Birinci bölümde İmam Muhammed'in biyografisi ve çalışmamıza esas aldığımız eseri Kitâbu'l-Asl'ın tanıtımına yer verilmiştir. İkinci bölümde islam hukukunda istihsan metodu ile ilgili genel bilgiler yer almaktadır. Üçüncü bölümde ise Şeybani'nin Kitâbu'l-Asl'ında yer alan istihsan örneklerine yer verilmiştir. | dc.description.abstract | This paper is a study about how the istihsan method is applied in Muhammad al-Shaybani's book "Al-Asl". The mentioned book is important because it is one of the main fiqh sources of the Hanafi Sect. The study consists of three parts. In the first part, the biography of Imam Muhammed and the introduction of his work Al-Asl, used as base of our study, are given. In the second part, general information about the istihsan method in Islamic law is given. In the third chapter, examples of istihsan in the Al-Asl of Al-Shaybani are given.
