Abstract
Her türlü tıbbi müdahale esasen kişinin hayatı, sağlığı ve cismani bütünlüğü gibi
mutlak ve vazgeçilmez haklarının ihlali anlamına gelir. Bu müdahalenin hukuka uygun
yapılabilmesi için hastanın aydınlatılmış rızası gereklidir. Ne de olsa, hastanın kendi
geleceğini serbestçe tayin etme hakkı mevcuttur. Hekimin, hastayı teşhis, önerilen tedavi,
bu tedavinin olası riskleri ve maliyetiyle alternatif tedavi metodları hakkında aydınlatması
gerekli ve önemlidir. Aksi halde, böyle bir aydınlatılmış rıza olmaksızın yapılan müdahale
hukuki ve cezai sorumluluğa yol açabilir. Ancak bazı hallerde, hastanın üstün özel yararı
veya üstün kamu yararı sebebiyle, istisnai olarak hekimin hastaya rıza almaksızın
müdahalesi mümkündür. Ayrıca belirtmek gereki ki, bazı hallerde hastanın mutlak ve
vazgeçilmez haklarıyla bağdaşmayan rıza beyanı hukuka aykırı olacaktır.
ABSTRACT Any medical intervention is considered per se as a violation of the absolute rights of the patient such as life, health and body integrity that everyone should respect. In order to avoid any violation, informed consent of the patient is required because the patient has the right of self determination. It is crucial that the patient is enlightened by the physician about the diagnosis, suggested treatment, potential risks and probable costs of this treatment and alternative methods. Otherwise, even in the benefit of the patient, civil or criminal responsibility of the physician may arise from the intervention because of the lack of informed consent. However, in some cases, by virtue of superior private interest of the patient or because of superior public interest, it is exceptionally not required for the physician to wait for any consent of the patient. If the consent of the patient doesn’t comply with his/her absolute rights, this consent is illegal.
