Özet
İnsanların fiziksel ve sosyal ihtiyaçları sebebiyle bir arada yaşamaları ile ortaya çıkan toplumsal yaşam beraberinde birtakım sorunları da getirmiştir. Bu sorunlardan biri insanların birbirine karşı haksızlık içeren davranışlarıdır. Suç olarak kabul edilen bu davranışları tekrar işlemekten geri durmayan kimselerin daha ağır yaptırımlara tabi tutulması toplumsal yaşamın başlangıcından itibaren insanların kamu otoritesinden beklentisi olarak varlığını sürdürmüştür. Bu nedenle tekerrür kurumu ortaya çıkmış, tekrar suç işleyen failler mükerrir kabul edilerek daha farklı ve ağır yaptırımlara tabi tutulmuştur. Çalışmamızın konusunu oluşturan tekerrür kurumu 3 bölüm halinde incelenmiştir. İlk bölümde tekerrür kavramı, tekerrür kurumunun amacı, tarihi gelişimi ve türleri üzerinde durulmuştur. İkinci bölümde tekerrür kurumunu açıklayan teoriler ve kurumun hukuki niteliği inceleme konusu yapılmıştır. Üçüncü bölümde ise Türk ceza hukukunda tekerrür kurumu incelenmiş, ayrıca kurumun hukukumuzda uygulanma koşulları ve sonuçları irdelenmiştir. Çalışma konumuzla ilgili mevzuat, kaynak kitap, makale ve akademik çalışmalar ile Yargıtay kararları taranmış, konu bu kapsamda ele alınmıştır.
Social life, which emerged when people lived together due to their physical and social needs, brought with it some problems. One of these problems is people's unfair behavior towards each other. Subjecting those who do not refrain from repeating these behaviors, which are considered crimes, to more severe sanctions has continued to exist as people's expectation from the public authority since the beginning of social life. For this reason, the institution of recidivism emerged, and perpetrators who committed crimes again were considered repeat offenders and were subjected to different and more severe sanctions. The institution of recidivism, which is the subject of our study, was examined in 3 parts. In the first part, the concept of recidivism, the purpose of the institution of recidivism, its historical development and types are focused on. In the second part, the theories explaining the institution of recidivism and the legal nature of the institution are examined. In the third chapter, the institution of recidivism in Turkish criminal law is examined, and the conditions and consequences of the institution's application in our law are examined. Legislation, reference books, articles, academic studies and Supreme Court decisions related to our subject of study have been scanned and the subject has been discussed within this context.
