Özet
Şer'i ahkâm lafızlar ile beyan edilmiştir. Lafızların ise konuluşları bakımından anlama delâletleri farklıdır. Usul ilminin en önemli meselelerinden biri lafzın anlamını sahih bir şekilde tespit etmektir. Çünkü şari'nin iradesinin anlaşılması, çoğu kez lafızların doğru bir şekilde tespit edilmesiyle mümkündür. Buna karşılık lafızların anlama delâletleri ise tek değildir. Konuluş ve kullanılışları, açıklılıkları ve delâletleri bakımından lafızlar farklılık gösterirler. Lafzın konuluşu esas alınarak yapılan tasnifin en önemli parçalarında biri âmm lafızdır. Âmm lafzın anlama delaleti çerçevesinin de fıkıh usulünde ele alınan en önemli konularından biri, âmm lafzın tahsisidir. Âmm lafzın tahsisinde Hanefi usulcüler ile mütekellim usulcüler arasında tartışma konusu olan muhassıslardan birisi ise akıldır. Tezimizde akıl ile tahsis konusunu savunan Hanefi usulcülerin görüşleri ile buna karşı çıkan usulcülerin görüşleri incelenmiştir. Tartışmanın temel dayanağı ve sonuçları gösterilmeye çalışılmıştır.
Decretals were declared with words. The meaning of the words are different in terms of insinuations. One of the most important issues of methodology science is that detecting of the meaning of a word correctly. Because, being understood legislator's(Allah) willpower, mostly it can be possible via determining words correctly. On the other hand, the meanings of the words are not unique. The words differ in terms of their basic meaning and using, their clarity and implication. In our thesis, as a method of assignment via mind which constricting of the meaning of general which is a type of wording in terms of the basic meaning were handled. Hanafi scholars' opinions which are about the assignment of general words via mind were presented and basic discussion area were tried to show. Opinions and results about accepting assignment by means of mind were tried to observe from Hanafi's sources
