Özet
Anglo-Sakson hukuk sisteminin önemli bir kurumu olan çapraz
sorgu, genel hatlarıyla açıklandı. Ayrıca, çapraz sorgunun itham sistemi
içerisindeki yeri ve özellikleri belirlendi. Türk hukukundaki doğrudan
soru sorma hakkının çapraz sorgu olup olamayacağı tartışıldı. Bununla
birlikte, çapraz sorgunun karma sistemdeki karşılığı ele alındı. Son olarak,
itham sisteminin ürünü olan bu kurumun Türk hukukunda
uygulanabilirliği tüm eleştirilerle birlikte değerlendirildi.
An important foundation of Anglo-Saxon juridical system, cross examination, is explained in general details. And also, the position and the characterictics of cross examination within the adversaril system are determined. Moreover, it is argued that the right of direct examination may be a cross examination in Turkish Law or not. However, retaliation of cross-examination in the mixed system is discussed. Lastly, the applicability of this foundation which is the product of impeachment system in Turkish Law is considered together with all criticism.
