dc.description.abstractKarar incelemesi kapsamında, İsviçre Federal Mahkemesinin 1 Nisan 2010 tarihli ve 4A_638/2009 sayılı eser sahipliğinin tespitine ilişkin kararı ele alınmıştır. Söz konusu karar Cenevre Kenti bünyesinde oluşturulmuş “Cenevreli İtfaiyecilerinin Turuncu Rehberi” isimli fikri ürünün eser sahipliğinin tespiti talepli davanın, Cenevre Kanton Mahkemesi Hukuk Dairesi’nde reddedilmesi üzerine bu ret kararının temyizen incelenmesine ilişkindir. Bu kapsamda söz konusu kararda, öncelikle temyiz incelemesi bakımından temyiz talep edenin tespit davası açmakta hukuki menfaati olup olmadığı, eser sahipliğinin tespiti talebi bakımından zamanaşımı ve iyiniyet olguları tartışılmıştır. Bu konuları aydınlatmak içinse eser sahibi olarak tanıtılma hakkının hukuki niteliği ele alınmıştır. Ardından temyiz incelemesi kapsamında “Cenevreli İtfaiyecilerinin Turuncu Rehberi”nin, “eser” olarak kabul edilip edilemeyeceği hususu tartışılmış ve eser sahipliği ile ortak eser sahipliği olguları değerlendirilmiştir. Karara ilişkin incelememiz, Federal Mahkemenin çizdiği sınırlar dâhilinde İsviçre Hukuku ile karşılaşmalı olup, Türk Hukuku kapsamında yapılmıştır.en_US
dc.description.abstractThe decision number 4A_638/2009 of 1st of April 2010 of Swiss Federal Court about declaratory action of authorship is examined in this paper. After the Civil Department of Canton Court of Genève declined the claim of authorship on the “Orange Guide of Firemen of Genève” which was created under the direction of City of Genève; the claimant filed an appeal to the Federal Court. First of all, the Federal Court discussed whether the appellant has a legal interest to bring a declaratory action of authorship; secondly the prescription and goodwill were discussed with respect to the claim of the declaratory action. The legal characteristic of right of attribution was taken into account in order to illuminate these facts. In the appellate review, it is discussed whether the “Orange Guide of Firemen of Genève” can be considered as an intellectual work and then the phenomenon of authorship and co-authorship were examined. Our court decision study which is limited in the framework of the Federal Court is not only within the context of Turkish Law but also Swiss Law in a comparative way.en_US
